Former National Counterintelligence Executive Former Mission Manager for Counterintelligence
Joel F. Brenner is the former national counterintelligence executive and the mission manager for counterintelligence at the Office of the National Counterintelligence Executive (ONCIX), which directs national counterintelligence (CI) for the United States government. In that position, Brenner also chaired the National Counterintelligence Policy Board, the principal inter-agency mechanism for developing national CI policies and procedures. He is an expert on cyber security and can provide insight and practical strategies for businesses on this complex issue.
Currently of counsel at Cooley LLP, Brenner specializes in global risk management, privacy and data security, and internal investigations. He has expertise in a wide variety of transactions and proceedings including sensitive foreign acquisitions, the liability of foreign governments, export controls, securities regulations, and grand jury proceedings. He has years of experience inside and outside government involving national and homeland security matters and enjoys working with start-up companies.
Security Background. Before joining Cooley, Brenner was senior counsel at the National Security Agency, advising its leadership on the public-private effort to create better security for the internet. From 2002–2006, he was the NSA’s inspector general, responsible for top-secret internal audits and investigations.
From 2006 until mid-2009, Brenner was the head of U.S. counterintelligence for policy and strategy under the director of national intelligence. He was responsible for integrating the counterintelligence activities of the 17 departments and agencies with intelligence authorities, including the FBI and CIA and elements of the Departments of Defense, Energy, and Homeland Security.
Authorship and Awards. Brenner is the author of America the Vulnerable: Inside the New Threat Matrix of Digital Espionage, Crime and Warfare, which discusses transparency and how that affects our nation’s CI. It also covers the implications for organizations and governments that have sensitive or proprietary information. Brenner has also written about intelligence oversight and presidential authority to suspend or prohibit foreign takeovers of U.S. firms, and is often quoted in the national media on data security, privacy, and intelligence issues.
Brenner was awarded the Intelligence Community Achievement Medal in July 2009.
Education and Other Information. He received his JD from Harvard Law School in 1975, his PhD from the London School of Economics and Political Science in 1973, and his BA from the University of Wisconsin–Madison in 1969. Brenner is a member of the Advisory Board of the American Bar Association’s Standing Committee on Law & National Security. He has also served as a prosecutor in the Justice Department’s Antitrust Division and has extensive trial and arbitration experience in private practice.
